Cuebao Terms of Service

These Terms are an agreement between you and Linghe Fangcheng (Beijing) Technology Co., Ltd. regarding your use of the Cuebao application, websites and related services. Please read and understand these Terms and the Cuebao Privacy Policy in full before registering, signing in or using the Service.

By clicking to agree, registering, signing in or actually using the Service, you confirm that you have read and agree to these Terms. If you do not agree, please stop registering for or using the Service.

1. The Service

Cuebao provides pet companionship, pet-care, interaction, account management, customer service and related technical support. The services available to you are those actually offered within the application. We will continue to improve the Service, and we may also adjust certain functions in light of laws and regulations, regulatory requirements, platform rules, security needs or operational arrangements.

2. Account registration and use

Use by minors. Minors should read and agree to these Terms under the guidance of a guardian before using the Service. Before a child under the age of fourteen uses functions that involve personal information, a guardian should read and agree to the Cuebao Children's Personal Information Protection Rules. If a guardian considers that a minor's account should be restricted or deleted, or that personal information should be handled, the guardian may contact us.

Service messages and verification. In order to complete registration, sign-in, account security, identity verification, confirmation of important operations and customer service, we may send verification codes, service notices and security alerts to the phone number, email address or other bound contact method that you have provided. Any related communication charges are levied by the carrier or service provider according to its own rules.

You must not use the Service to engage in conduct that is unlawful, infringes the rights of others, undermines the security of the Service or disrupts its normal operation, including but not limited to:

You are responsible for the content you create, enter or upload within the Service, and you warrant that you have the right to provide that content. In order to provide the Service, save your progress, display interaction results, handle customer service and perform legal obligations, you grant us a non-exclusive licence to store, reproduce, display, process and back up that content to the extent necessary.

If your content violates laws and regulations, these Terms, or the rights and interests of others, we may lawfully take measures such as deletion, blocking, restricting functions, or suspending or terminating the Service.

Intellectual property. The software, interface, text, graphics, audio, video, characters, trademarks, logos, rules, technology and documentation within the Cuebao service are owned by us or by duly authorised parties, except for content in which the relevant rights holders or users hold rights by law. Without permission, you must not copy, adapt, disseminate, rent, sell or use them for commercial purposes outside the Service.

5. Changes, suspension and termination of the Service

We may adjust, suspend or terminate parts of the Service in light of laws and regulations, regulatory requirements, platform rules, security needs or operational arrangements. If you breach these Terms or applicable laws, or infringe the rights and interests of others, we have the right to take measures including reminders, restrictions, suspension, termination of the Service, deletion of unlawful content and refusal of re-registration. You may stop using the Service and apply to delete your account at any time.

6. Disclaimers and limitation of liability

We will endeavour to provide a secure, stable and continuous service, but we do not guarantee that the Service will always be uninterrupted, error-free or fully meet all of your expectations. To the extent permitted by law, we are not liable for losses caused by force majeure, underlying communications failures, third-party service failures, government action, network attacks, causes attributable to the user, or other causes beyond our reasonable control. These Terms do not exclude liability that may not be excluded or limited by law.

7. Governing law and dispute resolution

The formation, validity, performance and interpretation of these Terms, and the resolution of disputes arising from them, are governed by the laws of the People's Republic of China. In the event of a dispute arising from these Terms, the parties should first seek to resolve it amicably through negotiation; if negotiation fails, either party may bring proceedings before the Beijing Internet Court in accordance with the law.

8. Updates to these Terms

We may update these Terms in light of laws and regulations, regulatory requirements or changes to the Service. Material changes will be notified to you through in-app prompts, website announcements or other prominent means. If you continue to use the Service after an update takes effect, you are deemed to accept the updated Terms.

Relationship between documents. These Terms, together with the Cuebao Privacy Policy, the Cuebao Personal Information Collection List, the Cuebao Third-Party Information Sharing List, the Cuebao System Permission Notice, the Cuebao Children's Personal Information Protection Rules and the Cuebao Data Compliance Notice, constitute the public rules you should be aware of when using the Service. Matters concerning the processing of personal information are governed by the Privacy Policy and the related lists.

Notices and service of notices. We may send you notices relating to the Service, your account, security and changes to these Terms through in-app prompts, in-service messages, the contact details you have provided, website announcements or other reasonable means. Once a notice has been sent, the time of service is determined in accordance with the law or the content of the notice.

Severability. If any provision of these Terms is held to be invalid, unenforceable or in need of adjustment, this does not affect the validity of the remaining provisions. The parties should continue to perform the remaining provisions in a lawful and valid manner that is closest to the original purpose.
